§ 200. Definitions. For the purposes of this article, the following\nterms shall have the following meanings:\n 1. "Dislocated worker" shall mean an individual who:\n (a) has been terminated or laid-off or who has received a notice of\ntermination or lay-off from employment, and is eligible for, currently\nreceiving, or has exhausted any entitlement to unemployment\ncompensation, and who is unlikely to return to a previous industry or\noccupation;\n (b) has been terminated or who has received a notice of termination of\nemployment, as a result of any permanent closure of a plant or facility;\n (c) is long-term unemployed and has limited opportunities for\nemployment or reemployment in the same or a similar occupation in the\narea in which such individual resides, including any older

§ 200. Definitions. For the purposes of this article, the following\nterms shall have the following meanings:\n 1. "Dislocated worker" shall mean an individual who:\n (a) has been terminated or laid-off or who has received a notice of\ntermination or lay-off from employment, and is eligible for, currently\nreceiving, or has exhausted any entitlement to unemployment\ncompensation, and who is unlikely to return to a previous industry or\noccupation;\n (b) has been terminated or who has received a notice of termination of\nemployment, as a result of any permanent closure of a plant or facility;\n (c) is long-term unemployed and has limited opportunities for\nemployment or reemployment in the same or a similar occupation in the\narea in which such individual resides, including any older individual\nwho has substantial barriers to employment by reason of age; or\n (d) was self-employed (including a farmer) and is unemployed as a\nresult of general economic conditions in the community in which the\nindividual resides or because of natural disasters as defined by the\nUnited States secretary of labor.\n 2. "Economically disadvantaged" shall mean an individual who receives,\nor is a member of a family who receives, cash public assistance\npayments, or is a member of a family which has a total family income for\nthe six-month period prior to enrollment in programs funded pursuant to\nthe provisions of this article, which, in relation to family size, was\nnot in excess of the higher of the poverty level or seventy percent of\nthe lower living standard income level, or is receiving food stamps.\n 3. "Educational agency" shall mean a school district, board of\ncooperative educational services, community college, agricultural and\ntechnical college, or degree-granting institution of higher education,\nor an independent not-for-profit organization which meets the standards\nof instructional quality established in regulation by the commissioner\nof education. These standards shall include, but not be limited to,\nqualifications of administrative and instructional personnel, quality of\nestablished curricula, facilities and equipment, recordkeeping,\nadmission, grading, attendance, and record of placement of completers\nwhich meets standards of acceptability as established by the\ncommissioner of education.\n 4. "Equipment" shall mean tangible personal property which will\nfurther the objectives of the supported program and for which a definite\nvalue and evidence in support thereof have been provided.\n 5. "Financial support" shall mean anything of value contributed by an\napplicant which is reasonably calculated to support directly the\ndevelopment and expansion of a particular program as defined in this\narticle and which represents an addition to any financial support\npreviously or customarily provided to such education agencies by the\ndonor, including, but not limited to, funds, equipment as defined in\nsubdivision four of this section, facilities, faculty and scholarships\nfor matriculating students and trainees.\n 6. "Interagency review committee" shall mean a committee chaired by\nthe commissioner and consisting of representatives from the state\neducation department, the department of labor, the department of social\nservices, the state university, the city university and the state job\ntraining partnership council. Such other state agencies, authorities,\nboards or commissions shall be consulted as the commissioner shall deem\nappropriate.\n 7. "Targeted individuals" shall mean residents of the state who are\ndefined as dislocated workers pursuant to subdivision one of this\nsection, as economically disadvantaged pursuant to subdivision two of\nthis section or as displaced homemakers.\n 8. "Technical assistance" shall mean professional and any other\nassistance provided by an applicant which is reasonably calculated to\nsupport directly the development and expansion of a particular program\nas defined in this article and which represents an addition to any\ntechnical assistance previously or customarily provided.\n
