§ 192. Administration. The department, in furtherance of the\nobjectives of the industrial effectiveness program, is hereby authorized\nand directed to:\n 1. provide productivity assessments and feasibility studies to\nindustrial firms that have requested such assistance directly or upon\nreferral by the department's regional offices, the New York state\nscience and technology foundation, the New York state urban development\ncorporation, or by other state agencies, authorities, offices or\ncommissions. Such productivity assessments and feasibility studies may\nbe provided directly by the department or by experts retained or\nsupervised by the department. Such productivity assessments and feasibility studies may\nbe provided directly by the department or by experts retained or\nsupervised by the department. Any expenditures for such assistance other\nthan for preliminary productivity assessments or feasibility studies\nshall be based on a plan reviewed and approved by the commissioner. The\nfollowing factors shall be considered in determining whether to provide\na productivity assessment or feasibility study to an industrial firm:\n(a) the potential viability of the company; (b) the commitment of\nmanagement and labor to jointly participate in a\nproductivity-improvement program; and (c) whether interests of the\nemployees of the firm would be served by such assistance. Industrial\nfirms and potential purchasers of existing industrial firms shall share\nthe cost of a productivity assessment or feasibility study provided by\nexperts retained or supervised by the department. The level of\ncontribution by a firm or by potential purchasers toward the cost of\nsuch an assessment or feasibility study shall not be less than fifty\npercent of the total cost;\n 2. identify public and private sources of expertise available to\nassess productivity problems of industrial firms and to work under\ncontract or in cooperation with the department in assisting such firms\nto undertake productivity-improvement activities;\n 3. identify individuals and firms with a distinctive competence in at\nleast one area related to industrial productivity, such as industrial\nmanagement, operations, production technology, marketing or labor\nrelations and training, and a demonstrated ability to serve small and\nmedium-sized industrial firms, for the purposes of referring small and\nmedium-sized industrial firms with identified needs to consultants with\nrelevant expertise;\n 4. design and conduct seminars and workshops to inform industrial\nmanagers, union leaders, trade associations, and other appropriate\nindividuals and organizations, of industrial productivity-improvement\nmethods and approaches and to demonstrate their successful adoption in\nsimilar firms;\n 5. publish a periodic newsletter to report on productivity research\nprojects and case studies, market the program's services and provide\nsuch other information as the commissioner deems appropriate;\n 6. conduct educational programs to inform industrial firms, labor\norganizations, banking organizations and other financial institutions,\nand industrial or local development agencies of the benefits and risks\nassociated with, and methods for effectuating, the transfer of ownership\nof industrial firms to employees, managers or other local investors;\n 7. promote the services and assistance available under this article\nfor industrial firms, to such firms and to municipal officials and\nagencies, regional and local economic development entities, technology\ndevelopment organizations, trade associations, business and labor\norganizations and other appropriate entities;\n 8. provide short-term management consulting services to industrial\nfirms, directly or through contracts, in order to assist such firms with\nassessing management, operations, market or financial problems;\n 9. provide information on state-sponsored programs offering financial\nor technical assistance to industrial firms and aid such firms in\napplying for assistance;\n 10. identify industrial firms in danger of closing or substantially\nreducing operations.\n
