§ 328. Powers and duties of the board. 1. The board shall serve as a\nresource center for the gathering and dissemination of information and\nprovide other assistance relating to 911 services and technologies.\n 2. The board shall monitor and periodically review the provision of\n911 services throughout the state, including but not limited to,\nconformance with applicable standards.\n 3. The board shall monitor and periodically review the provision of\n911 services throughout the state, including but not limited to,\nconformance with applicable standards.\n 3. The board shall assist municipalities in developing plans to\nestablish and implement enhanced 911 services utilizing state-of-the-art\ntechnologies and management systems.\n 4. (a) The board shall promulgate minimum standards for the operation\nof public safety answering points, which shall include, but not be\nlimited to, minimum staffing requirements, minimum educational\nqualifications for 911 call-takers and dispatchers, and minimum training\nrequirements for 911 call-takers and dispatchers, but which shall not\ninclude those standards required by paragraph (b) of this subdivision.\nIn promulgating such standards, the board shall examine national models\nof best practice. Such standards shall be promulgated no later than\nOctober first, two thousand three.\n (b) In addition, the board shall promulgate minimum standards\nregarding direct dispatch of all emergency services and jurisdictional\nprotocols. Such standards shall be promulgated no later than April\nfirst, two thousand three.\n 5. The board shall adopt standards governing reasonable eligible\nwireless 911 service costs for expedited deployment funding of enhanced\nwireless 911 service, repayment provisions, and the criteria for\napproval of priority enhanced wireless 911 plans for expedited\ndeployment funding. Standards for expedited deployment funding shall\nconsider whether the projected costs are reasonably necessary for the\nprovision of enhanced wireless 911 service and whether the priority\nenhanced wireless plan conforms to the FCC order.\n 6. The board shall review the certification and information submitted\nby a local public safety answering point, local governmental entity or\nthe division of state police to ensure the public safety answering\npoints are in compliance with the applicable standards that the board\nhas promulgated pursuant to subdivision four of this section. Where the\nboard determines that a local or state public safety answering point is\nnot in compliance with the applicable standards promulgated pursuant to\nsubdivision four of this section, the board shall follow the procedures\noutlined in section three hundred twenty-nine of this article.\n 7. The board shall develop procedures for a local government to\nterminate the routing of wireless 911 service calls to a local public\nsafety answering point for such local government.\n 8. The board shall develop and implement an educational plan for\ninforming the public about the enhanced wireless 911 service in New York\nstate. This plan shall include, but not be limited to, an explanation of\nthe enhanced wireless 911 system and a progress report on the\ncounty-by-county implementation of the statewide system. This\ninformation shall be provided via electronic, paper and telephonic\nmeans. Access to such information shall be made available for remote\ncomputer users through the internet or via telephone calls through a\ntoll-free hotline number. This plan shall be updated as new information\nbecomes available to the board not less than four times per year.\n 9. The board shall issue an annual report to the governor, the\ntemporary president of the senate, the minority leader of the senate,\nthe speaker of the assembly, and the minority leader of the assembly, on\nor before March first of each year, regarding the board's activities in\nthe previous calendar year, including but not limited to, the status of\n911 services across the state, including the extent to which public\nsafety answering points across the state are equipped to receive\nenhanced wireless 911 calls, the allocation of moneys from the fund\nincluding allocations made and not disbursed, and the disbursements of\nmoneys from the fund.\n 10. a. The New York state interoperable and emergency communication\nboard shall make recommendations to the commissioner of the division of\nhomeland security and emergency services on the expenditure of grants\nand other funding programs related to interoperable and emergency\ncommunications. In carrying out this responsibility, and consistent with\nthe mission of the division of homeland security and emergency services,\nthe board will make recommendations related to the development,\ncoordination and implementation of policies, plans, standards, programs\nand services related to interoperable and emergency communications,\nincluding but not limited to ensuring compliance with federal mandates\nfor interoperable communications and compatibility with the National\nIncident Management System.\n b. The board, in fulfilling its role to provide ongoing guidance\nregarding policies, plans, standards, programs and services related to\ninteroperable and emergency communications, shall:\n (1) establish structures and guidelines to maintain interoperable\ncommunications planning and coordination at the statewide level;\n (2) establish, promulgate and revise standards for the operation of\npublic safety answering points; and\n (3) establish guidelines regarding the creation of regionally based\nradio communications systems compatible with the structures and\nguidelines created under subparagraph one of this paragraph and with\nfederal mandates and best practices.\n
