§ 1707. Appeal to the court of appeals. An appeal may be taken direct\nto the court of appeals from a judgment or order which finally\ndetermines an action or special proceeding where the only question\ninvolved on the appeal is the validity of a statutory provision of the\nstate or of the United States under the constitution of the state or of\nthe United States. On any such appeal only the constitutional question\nshall be considered and determined by the court.\n
