§ 130-a. Cannabis showcase event permit.
1.When used in this section:\n (a) "Cannabis showcase event" shall mean an event where a licensee\nauthorized to conduct retail sales of adult-use cannabis, cannabis\nproducts, and cannabis merchandise engages in the sale and showcase of\nsuch products away from the licensed premises in partnership with at\nminimum one licensed New York state adult-use cannabis cultivator and at\nminimum one licensed New York state adult-use cannabis processor, at\nshowcase events that are located at stand-alone cannabis sale "pop-up"\nevents, farmers' markets and public markets as defined in section two\nhundred sixty of the agriculture and markets law or similar such\nlocations, as authorized by the office.\n (b) "Showcase" shall mean the exhibiting or displa

§ 130-a. Cannabis showcase event permit. 1. When used in this section:\n (a) "Cannabis showcase event" shall mean an event where a licensee\nauthorized to conduct retail sales of adult-use cannabis, cannabis\nproducts, and cannabis merchandise engages in the sale and showcase of\nsuch products away from the licensed premises in partnership with at\nminimum one licensed New York state adult-use cannabis cultivator and at\nminimum one licensed New York state adult-use cannabis processor, at\nshowcase events that are located at stand-alone cannabis sale "pop-up"\nevents, farmers' markets and public markets as defined in section two\nhundred sixty of the agriculture and markets law or similar such\nlocations, as authorized by the office.\n (b) "Showcase" shall mean the exhibiting or displaying at a cannabis\nshowcase event by a permittee or an authorized licensee of adult-use\ncannabis and cannabis products and may include branded merchandise and\neducational materials.\n 2. A licensee authorized under this chapter to conduct retail sales of\nadult-use cannabis may apply to the office for a cannabis showcase event\npermit and shall be required to demonstrate that they are in partnership\nwith a licensed cultivator and a licensed processor pursuant to\nsubdivision one of this section. An application for a cannabis showcase\nevent permit shall identify such licensed cultivators and processors who\nare authorized under this chapter to showcase at such cannabis showcase\nevent.\n 3. A cannabis showcase event permit shall authorize: (a) the permitted\nlicensee, authorized under this chapter to conduct retail sales of\nadult-use cannabis, adult-use cannabis products, and cannabis\nmerchandise, and (b) the permitted licensee and licensees who are\nauthorized under this chapter to cultivate or process adult-use\ncannabis, to showcase their adult-use cannabis and cannabis products,\nfor a temporary period of time, at a cannabis showcase event. The\npermittee shall offer for sale the adult-use cannabis and adult-use\ncannabis products cultivated or processed by the licensees authorized on\nthe permit to showcase at such cannabis showcase event, provided,\nhowever, the permittee shall not be limited to selling the products of\nsuch authorized licensees.\n 4. All adult-use cannabis and cannabis product sales at a cannabis\nshowcase event shall be executed by the permittee. No other licensee,\nperson or entity shall be authorized to engage in cannabis or cannabis\nproduct sales at a cannabis showcase event.\n 5. A separate cannabis showcase event permit shall be required for\neach showcase event at which a cannabis showcase event is being held.\n 6. A separate cannabis showcase event permit shall be required for\neach licensee authorized under this chapter to conduct retail sales of\nadult-use cannabis and cannabis products.\n 7. In the event a cannabis showcase event contains more than one\npermittee, each permittee shall nevertheless be required to partner with\nat minimum one cultivator, pursuant to subdivision two of this section.\n 8. Each permittee shall be limited to partnering with no more than one\nlicensed processor for each licensed cultivator authorized on their\ncannabis showcase event permit application.\n 9. No cannabis showcase event permit shall authorize more than one\ncannabis showcase event at one time. A licensee may participate in more\nthan one cannabis showcase event so long as each cannabis showcase event\nhas a corresponding separate cannabis showcase event permit.\n 10. Notwithstanding any other provision of this chapter, a cannabis\nshowcase event permit shall be valid for no more than fourteen days.\n 11. The board may set reasonable fees for cannabis showcase event\npermits. Such fees may be based on cannabis showcase event permit size,\nlength, duration, or any other factors deemed reasonable and appropriate\nby the board to achieve the policy and purpose of this chapter.\n 12. Permitted licensees shall comply with all reporting requirements,\nincluding required sales reporting, and all other requirements set forth\nin regulations. Any noncompliance by such permitted licensees or\nlicensees authorized on the permit to showcase shall subject such\nlicensees to applicable fees, fines and penalties.\n 13. The board shall promulgate regulations to implement this section.\n
