§ 4.07. Powers and duties of commission. The commission shall have the\nfollowing responsibilities, powers and duties:\n 1. To make recommendations to state agencies regarding the custody,\ndisplay, conservation, preservation and maintenance of works of art in\nthe empire state plaza under the jurisdiction of such agencies;\n 2. To appraise and catalogue works of art in the empire state plaza;\n 3. To advise and assist state agencies in the preparation and\ndistribution of publications by such agencies;\n 4. To make recommendations to the governor, the legislature and the\ncommissioner of general services regarding the purchase of works of art\nfor display at the empire state plaza;\n 5. To solicit and acquire by gift, grant or loan such works of art for\ndisplay at the empire state

To enter into such contracts as may be necessary or appropriate for\nthe performance of the functions vested in it by this article;\n 7. To render such assistance as the legislature or either house\nthereof may request with respect to the legislative office building and\nother offices and facilities of the legislature in the empire state\nplaza;\n 8. To render such assistance as the commissioner of education may\nrequest with respect to the cultural education center;\n 9. To make an annual report to the governor and the legislature on or\nbefore December fifteenth which shall contain a complete inventory of\nthe works of art in the empire state plaza, a summary of the\naccomplishments of the commission for the prior year, as well as its\nprojects planned for the current year, and such recommendations\npertinent to the duties of the commission as it deems advisable. Such\nreport shall contain a full fiscal accounting of the activities of the\ncommission, both current and projected;\n 10. To solicit and accept gifts, contributions and bequests of funds\nfrom individuals, foundations, corporations and other organizations or\ninstitutions for purposes of the commission. All funds of the commission\nfrom such gifts, contributions and bequests shall be deposited in a\nstate fiduciary fund, expenditures from which shall be limited to the\npurposes of the commission set forth in this article;\n 11. To establish a program, in consultation with the commissioner of\ngeneral services, for the promotion of the empire state plaza art\ncollection to the public through such means as determined by the\ncommission to be appropriate, including, but not limited to, educational\nseminars, remote exhibitions, special events and the sale of souvenirs\nor mementos related to the collection. All receipts of the commission\nfrom promotional efforts shall be deposited in a state fiduciary fund,\nexpenditures from which shall be limited to the purposes of the\ncommission set forth in this article.\n
