* § 25.35. Criminal penalties. 1.

(a)Any person, firm, corporation or\nother entity, whether or not domiciled, licensed or registered within\nthe state, which is convicted of violating section 25.27 or 25.29 of\nthis article shall be guilty of a class A misdemeanor punishable by a\nfine not to exceed one thousand dollars or two times the amount of the\ndefendant's gain, to be determined pursuant to the procedures set forth\nin section 400.30 of the criminal procedure law, whichever is greater,\nor by a term of imprisonment not to exceed one year, or by both such\nfine and imprisonment.\n (b) Any person, firm, corporation or other entity, whether or not\ndomiciled, licensed, or registered within the state, which is convicted\nof violating section 25.27 or 25.29 of this article, when the
