New Mexico Statutes
§ 38-1-13 — [Notice of proceedings occurring prior to service of
summons or appearance.] Whenever any proceeding is to be had prior to service of summons or appearance, at least five days' notice thereof shall be given, unless otherwise ordered by the court, and it shall be served on the party himself, and proof thereof made in the manner provided for service and return of summons.
