§ 45:7-83 — Requirements for seller of certain funeral arrangements, agreements
New Jersey·Title 45 PROFESSIONS AND OCCUPATIONS
2. a. No person, firm or corporation shall sell, or offer to sell, or make or offer to make at need funeral arrangements, preneed funeral arrangements or prepaid funeral agreements, unless that person, firm or corporation:
(1)is duly licensed and registered pursuant to the "Mortuary Science Act," P.L.1952, c.340 (C.45:7-32 et seq.), to engage in the business and practice of funeral directing or mortuary science; and (2) has his or its business and practice based within the physical confines of the registered mortuary. b. No person, firm or corporation, shall engage in the business and practice of funeral directing or mortuary science at any permanent facility that is not a registered mortuary. c.
