Text
If a justice knowingly accepts insufficient bail or fails to make return of his proceedings as required by law, he shall be liable to the same punishment as for aiding an escape in a like case; provided, that this section shall not apply to release on personal recognizance upon a finding by the justice that such release is proper under the circumstances of the case.
