§ 564-F:18-1803 — Damages in Absence of Breach of Duty

(a)Even absent a breach of duty, a foundation official is accountable to an affected beneficiary for any profit made by the foundation official arising from the foundation's administration.
(b)Absent a breach of duty, a foundation official is not liable to a beneficiary for a loss or depreciation in the value of the foundation property or for not having made a profit.
(c)This section does not preclude the payment of reasonable compensation to a foundation official.
