If the question of necessity shall be finally determined in the affirmative, the public utility may enter upon and use the land or rights adjudged necessary, upon the payment or tender of the compensation and damages awarded by the commission. If the owner is represented by a guardian, or guardian ad litem, payment or tender under this section may be made to such guardian, and said guardian shall pay over any balance due the ward to the ward or his legal representative or, in the absence of both, to the state treasurer for the owner's use.
