§ 236:104 — Compensation

New Hampshire·Title XX TRANSPORTATION·Ch. 236 HIGHWAY REGULATION, PROTECTION AND CONTROL REGULATIONS·Subdivision Control of Junk Yards and Automotive Recycling Yards
Just compensation shall be paid the owner for the relocation, removal, or disposal of any junk yard lawfully established under state law, which is required to be removed, relocated, or disposed of pursuant to 23 U.S.C. § 136. No rights to compensation accrue until a taking or removal has occurred. Notwithstanding the foregoing provisions, no junk yard which does not conform with the provisions of this subdivision or any rule or regulation adopted under this subdivision, shall be required to be relocated, removed or disposed of at any time if the federal share of just compensation is not available to make such payment.
