Nothing in this chapter shall be construed to prevent the department of environmental services from regulating, whether by adoption of rules, issuance of permits, or enforcement of statutes, rules, or permits, such aspects of mining operations that are within the scope of the programs implemented by the department of environmental services, including those relating to air quality, surface water quality including wastewater disposal, groundwater protection, management of solid and hazardous wastes, and site cleanup and reclamation.
