The commissioner of the department of environmental services shall: I. Report to the commissioner any violation by a mining operator of:

(a)Any statute for which the department of environmental services has enforcement authority;
(b)Any permit issued by the department of environmental services; and
(c)Any rule adopted by the department of environmental services. II. Give notice to the commissioner of any proceeding by the department of environmental services to revoke, suspend, or modify any permit issued to a mining operator by the department of environmental services. III. Investigate any alleged violation by a mining operator of any statute, rule, or condition of any permit issued by the department of environmental services and report the results of such investigation to the commissi
