Text
A licensed social worker who has substantial evidence a licensee has an active addictive
disease for which the licensee is not receiving treatment under a program approved by the
board under an agreement entered under this section, is diverting a controlled substance, or is
mentally or physically incompetent to carry out the duties of the license, shall report the
evidence to the board. An individual who reports under this section in good faith and without
malice is immune from any civil or criminal liability arising from the report. Failure to provide a
report within a reasonable time may be considered grounds for disciplinary action against the
licensee.
