Text
1.Any information created, collected, or maintained by the milk marketing board under
this chapter is confidential and not subject to the open records requirements of section
44-04-18, except that the board may:
a.Utilize the information in the administration of this chapter;
b.Provide testimony regarding the information in a judicial proceeding or an
administrative proceeding conducted in accordance with chapter 28-32;
c.Provide the information to the agriculture commissioner for the purpose of
determining a licensee's financial condition, as required by chapter 4.1-25; and
d.Utilize the information in compiling and disseminating general statistical data.
2.Any person divulging confidential information in violation of this section is guilty of a
class A misdemeanor.
