1.If an applicant or licensee fails to file a surety bond or other security within the time
fixed by section 4.1-25-09 or fails to comply with a demand for additional security, the
department shall publish in newspapers having circulation in the areas where the
producers whose milk is sold or delivered to the applicant or licensee reside, a notice
stating:
a.The department made a demand for additional security from the applicant or
licensee;
b.The applicant or licensee has failed to comply;
c.The department does not have on file a surety bond or other security as
demanded; and
d.Adequate security to protect producers may not be available to them.
2.In addition to a published notice to producers, the department shall send, by registered
mail, a copy of the notice to each producer deli
