§ 12.1-32-12 — Penalties, sentences, and parole for offenses unclassified and in other titles

North Dakota·Title 12.1 Criminal Code·Ch. 12.1-32 Penalties and Sentencing

titles. Where an offense is defined by a statute or by the constitution without specification of its classification pursuant to section 12.1-32-01, the offense is punishable as provided in the statute or constitutional provision defining it, or:

1.If the offense is declared to be a felony, without further specification of punishment, it is punishable as if it were a class C felony.
2.If the offense is declared to be a misdemeanor, without further specification of punishment, it is punishable as if it were a class A misdemeanor. The sentencing alternatives available under section 12.1-32-02 are available to a court sentencing an offender for commission of an offense defined by a statute outside this title.
