At the beginning of each examination conducted under section 12.1-04.1-05, the tier 1a
mental health professional shall inform the defendant the examination is being made at the
request of the prosecuting attorney; the purpose of the examination is to obtain information
about the defendant's mental condition at the time of the alleged offense; and information
obtained from the examination may be used at trial and, if the defendant is found not guilty by
reason of lack of criminal responsibility, in subsequent proceedings concerning commitment or
other disposition.
