72-15-205 . Deposit of money with county treasurer -- withdrawals for administrative costs -- investment.

(1)It is the duty of a public administrator, as soon as the public administrator receives money, to deposit with the county treasurer of the county in which probate proceedings are pending all money of the estate, and the money may be drawn upon the order of the personal representative, countersigned by a district judge when required for the purposes of administration.

(2)It is the duty of the county treasurer to receive and safely keep all money and pay it out upon the order of the personal representative, when countersigned by a district judge and not otherwise, and to keep an account with the estate of all money received and paid to the county treasurer. 72-15-205 . Deposit of money with county treasurer -- withdrawals for administrative costs -- investment. (1) It is the duty of a public administrator, as soon as the public administrator receives money, to deposit with the county treasurer of the county in which probate proceedings are pending all money of the estate, and the money may be drawn upon the order of the personal representative, countersigned by a district judge when required for the purposes of administration.
(2) It is the duty of the county treasurer to receive and safely keep all money and pay it out upon the order of the personal representative, when countersigned by a district judge and not otherwise, and to keep an account with the estate of all money received and paid to the county treasurer. The county treasurer and the sureties of the county treasurer are liable on the treasurer's official bond for the safekeeping and payment of all money.
(3) The money deposited with the county treasurer may, upon order of the court or judge, be invested pending the proceedings in securities of the United States or of this state when the investment is for the best interests of the estate.
