33-15-301 . Requiring standard provisions -- waiver.

(1)Insurance contracts must contain the standard or uniform provisions and benefits required by the applicable provisions of this code pertaining to contracts of particular kinds of insurance. The commissioner may waive a particular provision in a particular insurance policy form if:
(a)the commissioner finds the provision or benefit unnecessary for the protection of the insured and inconsistent with the purposes of the policy; and
(b)the policy is otherwise approved by the commissioner.
(2)A policy or certificate may not contain any provision or benefit inconsistent with or contradictory to any standard or uniform provision or benefit used or required to be used, but the commissioner may approve any substitute provision or benefit t
