Text

The sale may be in a manner recommended by the referee or referees' report, if any, and approved by the court to be commercially reasonable to bring about the highest and best price, at the best terms. The sale and terms shall be approved by the court prior to the sale. If the court determines that the parties will not cooperate in a sale or division of the property, the court shall empower the referee with all authority to execute all documents to conclude the sale or partition in kind. The court may confirm the sale after notice to all affected parties.
