Subdivision 1.Financial institution information.

(a)Any documents, materials, or other information in the control or possession of the department that are furnished by a licensee or a licensee's employee or agent acting on behalf of a financial institution pursuant to section46A.06or that are obtained by the commissioner in an investigation or examination pursuant to section46A.07:
(1)are classified as confidential, protected nonpublic, or both;
(2)are not subject to subpoena; and (3) are not subject to discovery or admissible in evidence in any private civil action.
(b)Notwithstanding paragraph (a), clauses (1) to (3), the commissioner is authorized to use the documents, materials, or other information in the furtherance of any regulatory or legal action brought as a part of the comm
