Subdivision 1.Private remedies.

(a)Any person injured or threatened with injury by a dealer or manufacturer's violation of sections327B.01to327B.12may bring a private action in any court of competent jurisdiction.
(b)A borrower injured by a violation of the standards, duties, prohibitions, or requirements of sections327B.08, subdivision 6;327B.09, subdivision 6; or327B.095, shall have a private right of action and the court shall award actual, incidental, and consequential damages. Subd. 2.Fraud remedies. In addition to the remedies provided in sections327B.01to327B.12, any violation of section327B.08or327B.09is a violation of section325F.69, subdivision 1and the provisions of section8.31shall apply. A private right of action by the borrower under this chapter is in the public interest
