Section 168E.

(a)For the purposes of this section, the following terms shall have the following meanings unless the context clearly requires otherwise:''Institution'', a public or independent institution of higher education located in the commonwealth and authorized to grant degrees pursuant to any general or special law.''Reporting party'', a student or employee of an institution who reports being subject to an incident of sexual misconduct to the institution.''Responding party'', a student or employee of an institution who has been accused of an alleged incident of sexual misconduct.''Sexual misconduct'', an incident of sexual violence, dating violence, domestic violence, gender-based violence, violence based on sexual orientation or gender identity or expression, sexual assault, sexual
