§1317. Regulation by the Public Service Commission
A.The Public Service Commission shall regulate the corporation as provided for in
this Part with the same plenary regulatory authority as provided under the Constitution of
Louisiana with respect to public utilities. Such regulation shall be concomitant with the
Public Service Commission's regulation of public utilities. Notwithstanding such regulation,
as provided in R.S. 45:1327, the corporation is not a public utility. Although the
organization and operations of the corporation shall be regulated exclusively by the Public
Service Commission, any financing order pertaining to a utility furnishing utility service
within the city of New Orleans shall be issued by the council of the city of New Orleans and
