§98.12. Public water supply prioritization
Notwithstanding any other provision of law to the contrary, in carrying out its
authorities established by this Part the department shall prioritize and protect the
sustainability of public water supplies in its management and regulatory decisions, consistent
with the policy established in R.S. 38:3097.6. In exercising its authority under this Part, the
department shall ensure that no regulatory or permitting action undermines or adversely
impacts the availability or quality of water necessary for public water supply systems.
