Text

A cooperative may:

(1)Sue and be sued, in its corporate name;
(2)Have perpetual existence, unless otherwise provided for in the articles of incorporation of the cooperative;
(3)Adopt a corporate seal and alter the same at pleasure;
(4)Generate, manufacture, purchase, acquire, accumulate and transmit electric energy, and distribute, sell, supply, and dispose of electric energy to its members, to governmental agencies and political subdivisions, and to other persons not in excess of ten per centum of the number of its members; provided, however, that should a cooperative acquire any electric facilities dedicated or devoted to the public use, it may, for the purpose of continuing service and avoiding hardship and to an extent which together with all other persons served by the cooperative
