§ 8-25-6-2 — Prerequisites for township opt-in

(a)This subsection does not apply to townships located in Hendricks County. If:

(1)the fiscal body of the county in which a township is located does not adopt an ordinance under IC 8-25-2-1; and

(2)the township is adjacent to:

(A)an eligible county in which:

(i)a public transportation project has been approved under IC 8-25-2; or

(ii)an ordinance described in IC 8-25-2 has been adopted; or

(B)another township in which:

(i)a public transportation project has been approved under this chapter; or

(ii)a resolution described in this section has already been passed; the fiscal body of the township may pass a resolution to place on the ballot a local public question on whether the fiscal body of the eligible county should be required to fund and carry out a public transportation project

(a) This subsection does not apply to townships

this chapter; or
(ii) a resolution described in this section has already been

the fiscal body of the township may pass a resolution to place on the
ballot a local public question on whether the fiscal body of the eligible
county should be required to fund and carry out a public transportation
project in the township.
(b) This subsection applies to Guilford Township in Hendricks
County. The township fiscal body may pass a resolution to place on the
ballot a local public question on whether the township fiscal body
should be required to fund and carry out a public transportation project
in the township.
(c) The fiscal body of the township shall include in the resolution
passed under subsection (a) or (b):
(1) a description of the public transportation services that will be
provided in the township through the proposed public
transportation project; and
(2) an estimate of each tax necessary to annually fund the public
transportation project in the township.
