Text
Whenever a state highway is being
constructed or reconstructed and the highway crosses or intersects a
railroad, the department may, if in its opinion it is practicable, separate
grades at the crossings. If the department is unable to agree with the
railroad as to the separation and the method of accomplishing the
separation, the department shall apply to the utility regulatory
commission by verified petition asking that the grades be separated at
the crossing.
