§ 8-23-9-38 — Claims against contractors; failure to file action and certificate
If a claimant does not file an action under section 36 of this chapter within the time specified in the notice or fails to file with the department the certificate of the clerk, the department shall pay the amount held by the department on the claim to the contractor. If the claim has been protected by check, bond, or security, the check, bond, or security shall be delivered to the contractor. If the check, bond, or security has been deposited for the protection of two
(2)or more claimants, the check, bond, or other security shall be held
by the department for the protection of all claimants until all are either
released, waived, or satisfied.
