§ 8-23-20-12 — Compensation determination; civil actions
If a claimant under section 11 of this chapter
and the department do not reach agreement on the amount of
compensation to be paid within one hundred twenty (120) days after
the claim is filed, the claimant may file a civil action to have the
compensation determined. An action under this section shall be filed
in a court of general jurisdiction in either the county where the sign and
real property are located or in the county in which the claimant resides.
The county of residence of a corporation shall be determined under the
applicable statutes. An action under this section shall be filed not later
than one (1) year after the filing with the department of a claim for
compensation under section 10 of this chapter.
