Text
This chapter is not applicable to the
purchase of a parcel of real property by an agency if the agency head
gives notice in writing to the owner of the property not later than the
date of its first offer to purchase the property that the agency will not
exercise a right it may have to acquire the property through exercise of
the power of eminent domain. Proceedings in eminent domain may not
thereafter be instituted by the agency with respect to the real property
unless the notice is expressly revoked in writing. If the notice is
revoked, the provisions of this chapter are applicable as if the agency
