§ 8-21-9-20 — Restricted zones in airports; air pollution restrictions
In order to provide free air space for the safe
descent, landing and ascent of aircraft and for the proper and safe use
of any airport or landing field acquired or maintained under this
chapter, the department is hereby given the right, powers and authority
to establish and fix by ordinance or ordinances a restricted zone or
zones for such distance in any direction from the boundaries of such
airport or landing field, within which zone or zones so established, as
in the opinion of the department is necessary and practicable, no
building or other structure shall be erected high enough to interfere
with the descent of an aircraft at such approach angle as may be
deemed reasonably necessary for the safety for the type of operation
that is, or is anticipated to be, conducted at such landing fi
