If a county, city, or town wants to establish a transportation system that would compete with a motor carrier that is:

(1)operating under the jurisdiction of the department; and
(2)providing transportation service in the territorial jurisdiction of the county, city, or town; the county, city, or town must first apply for and obtain a certificate under section 12.5 of this chapter.
