3.

(a)Actions taken with respect to:
(1)the issuance of a request for proposals;
(2)the determination of responsible and eligible offerors; and
(3)the preliminary selection of an operator by the authority; for a public-private agreement before March 15, 2006, that would have been valid under this article, as added by P.L.47-2006, are legalized and validated.
(b)All agreements relating to a project that:
(1)is located within a metropolitan planning area (as defined by 23 U.S.C. 134); and
(2)connects the state of Indiana with the commonwealth of Kentucky; are hereby legalized and declared valid if entered into before April 15, 2013.
(c)All proceedings and any action taken at a proceeding concerning the making, execution, or approval of an agreement described in subsection (b) are ful
