5.The department of natural resources may
establish and maintain, within all ports created under this chapter and
in operation on July 1, 1975, areas for the use of the citizens of this
state for public fishing from the shore. The ports of Indiana shall
cooperate fully with the department of natural resources in the
implementation of this section. However, if the site of any public
fishing area established under this section is subsequently leased to
others for agricultural, industrial, or commercial purposes, or if
required to maintain port security, the ports of Indiana may limit or halt
public fishing in that area.
