3. For purposes of section 3 of this chapter, a utility service board that:
(1)was established before January 1, 1983, under IC 8-1-2-100
(before its repeal and formerly Acts 1913, c.76, s.109, as
amended);
(2)has continued in existence without interruption since its
creation; and
(3)was established without submitting the question of its creation
to the voters of the municipality for approval in a referendum;
is legalized and its actions validated.
