Text
Infrastructure and Serving Class III Gaming
on the South Bend Site. To the extent that the Band determines that it
is not feasible and desirable to extend existing Band infrastructure or
develop new Band infrastructure to provide water, sewer, or other
essential utility services to the South Bend Site in order to provide for
the safe and sanitary operation of a Gaming Facility on such site, the
Band shall arrange for such services to the site through public or
private providers on such terms and at such costs as would apply to
other similar customers under applicable law.
