If the General Assembly of the State rejects
the renewal of this Compact for a Renewal Term under section 2 of this
chapter or section 3 of this chapter, the Band may request to negotiate
a successor compact by serving written notice on the State prior to the
expiration of the Initial Term or the Renewal Term then in effect. In the
event that the Band serves written notice on the State under this
subsection and the parties are unable to conclude a successor compact
prior to the expiration of the Initial Term or Renewal Term then in
effect, then this Compact shall remain in effect pending exhaustion of
the administrative and judicial remedies set forth in IGRA, provided
that in the event that the State raises the defense of sovereign immunity
in the administrative or judicial proceedings, t
