§ 4-22-2.3-10 — Interim rules to implement reductions, waivers, or elimination of fees, fines, or civil penalties

(a) An agency may adopt interim rules
under IC 4-22-2-37.2 to implement a reduction, a full or partial waiver,
or an elimination of a fee, fine, or civil penalty included in a rule
adopted under IC 4-22-2.
(b) An interim rule authorized under this section expires not later
than January 1 of the fifth year after the year in which the rule is
accepted for filing by the publisher of the Indiana Register.
(c) A rule described in this section may be continued:
(1) if the agency readopts the rule:
(A) without changes in conformity with the procedures in IC 4-22-2.6-3 through IC 4-22-2.6-9; or
(B) with or without changes in conformity with the procedures
in IC 4-22-2-23 through IC 4-22-2-36; or
(2) in another interim rule only if the governor determines under
IC 4-22-2-37.2(c) that the policy options available to the agency
are so limited that the use of the additional notice, comment, and
review procedures in IC 4-22-2-23 through IC 4-22-2-36 would
provide no benefit to persons regulated or otherwise affected by
the rule.
