Text
Upon any petition to sell or mortgage real
property the court shall have power to investigate and determine all
questions of conflicting and controverted title, remove clouds from any
title or interest involved, and invest purchasers or mortgagees with a
good and indefeasible title to the property sold or mortgaged. When the
petition to sell or mortgage seeks such relief notice shall be given as in
civil actions of like nature and the court is authorized to issue
appropriate process and notices in order to obtain jurisdiction to so
proceed against adverse parties.
