Effective 1-1-2026. Sec. 906.
(a)The director may enter into a consent
order with a person to resolve a matter arising under this chapter.
(b)A consent order must:
(1)be signed by the person to whom it is issued or by an
authorized representative of that person; and
(2)indicate agreement to the terms contained within the consent
order.
(c)A consent order does not:
(1)constitute an admission by a person that a provision of this
chapter or an order promulgated or issued under this chapter has
been violated; or
(2)constitute a finding by the director that the person has violated
a provision of this chapter or an order promulgated or issued
under this chapter.
(d)Notwithstanding the issuance of a consent order, the director
may seek civil or criminal penalties or compromise civil penal
