Text
Effective 1-1-2026. Sec. 301. This chapter does not apply to the following:
(1)A federally insured depository financial institution, which may
provide earned wage access services in Indiana without obtaining
a license under this chapter.
(2)An individual employed by:
(A)a licensee; or
(B)a person exempt from the licensing requirements of this
chapter;
when acting within the scope of employment and under the
supervision of the licensee or exempt person as an employee and
not as an independent contractor.
(3)An employer that offers a portion of salary, wages,
compensation, or other income directly to its employees or
independent contractors before the normally scheduled pay date.
