Text
(a)A substance is subject to this chapter if the
substance is on the list published under 42 U.S.C. 11002(a)(2).
(b)Except as provided in section 6 of this chapter, a facility is
subject to this chapter if a substance on the list referred to in subsection
(a)is present at the facility in an amount that exceeds the threshold
planning quantity established for the substance.
(c)For purposes of emergency planning, the Indiana emergency
response commission may designate additional facilities that are
subject to this chapter if the designation is made after public notice and
opportunity for comment. The commission shall notify a facility
affected by a designation under this section.
