§ 13-25-2-16 — Civil actions by state or unit of local government

Indiana·Art. 25 HAZARDOUS SUBSTANCES·Ch. 2 Emergency Planning and Notification

The state or a unit of local government may commence a civil action against an owner or operator of a facility for failure to do any of the following:

(1)Provide notification to the emergency response commission under section 3 of this chapter.
(2)Submit a material safety data sheet or a list under section 8 of this chapter.
(3)Make available information requested under section 8 of this chapter.
(4)Complete and submit an inventory form under section 9 of this chapter containing tier I information unless the requirement does not apply under section 9(b) of this chapter. [Pre-1996 Recodification Citation: 13-7-37-20(b).]
