Text

A unit of local government may not enact or enforce an ordinance that requires:

(1)a permit;
(2)a license;
(3)an approval;
(4)an inspection; or
(5)the payment of a fee or tax; for the installation, use, retrofitting, closure, or removal of an underground storage tank or aboveground storage tank unless the department has approved the ordinance or a proposed ordinance in writing. [Pre-1996 Recodification Citation: 13-7-20-43(c).]
