§ 13-22-13-2 — Restrictions on corrective action

Under section 1 of this chapter, the
commissioner or a court may order the performance of corrective
action beyond the boundaries of the facility from which the release
occurs. However, the commissioner may not order corrective action
beyond the boundaries of the facility if the owner or operator of the
facility demonstrates to the satisfaction of the commissioner that,
despite the best efforts of the owner or operator, the owner or operator
is unable to obtain the necessary permission to undertake the corrective
action.
