Text

(a)Based upon the contents of the state plan and on rules adopted by the board, the commissioner shall approve or disapprove each district plan submitted for review under this chapter within one hundred twenty (120) days after the plan is submitted to the commissioner.
(b)If the commissioner fails to act within one hundred twenty (120) days after a district plan is submitted, the district plan is considered approved. [Pre-1996 Recodification Citation: 13-9.5-4-3(a),
